Terms of Service

These Terms of Service ("Terms") govern your use of AgentMorning ("we", "us", "our"), a lightweight CRM for solo real estate agents. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use AgentMorning.

Eligibility

You must be at least 18 years old and able to form a binding contract to use AgentMorning. By using the service you represent that you meet these requirements.

Your account

You sign in using Google OAuth. You are responsible for maintaining the security of your Google account and, by extension, your AgentMorning account. One account per person — do not share your access. Notify us immediately if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.

Service description

AgentMorning is a CRM tool for managing real estate contacts, follow-ups, pipeline stages, and communication sequences. It helps you organize who to call, text, or email and when. AgentMorning is not a communication platform — it generates links and templates, but you send messages through your own phone, email, or SMS provider. It is not an MLS, IDX, or property listing service.

Free and paid plans

AgentMorning offers a free tier limited to 10 contacts. Paid plans (monthly or annual) unlock unlimited contacts and are billed through Polar. By subscribing you agree to Polar's payment terms. You can cancel your subscription at any time — cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods. Pricing may change with 30 days' notice.

Your data and ownership

You own everything you put into AgentMorning — contacts, interactions, follow-ups, sequences, and any other content. We do not claim intellectual property rights over your data. You can export all your data in JSON format at any time from Settings. If you delete your account, we permanently remove all your records within 30 days.

We will never sell or share your data. We only process it to provide the service, as described in our Privacy Policy.

Acceptable use

You agree not to:

• Use AgentMorning to spam, harass, or contact people who have asked you to stop
• Violate any applicable law, regulation, or real estate industry rule (including CAN-SPAM, TCPA, and Do Not Call regulations)
• Upload malicious content, viruses, or harmful data
• Attempt to access other users' data or accounts
• Scrape, reverse-engineer, or attempt to extract the source code of the service
• Share your account credentials or let others use your account
• Use the service for any purpose other than managing your real estate business relationships

AgentMorning is a tool — you are solely responsible for how you use it and for complying with all laws that apply to your communications and business practices.

Intellectual property

The AgentMorning name, logo, website design, and underlying code are our property (or licensed to us) and are protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the service for its intended purpose. This license does not include the right to copy, modify, distribute, or create derivative works of the service itself.

Limitation of liability

To the maximum extent permitted by law, AgentMorning and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of (or inability to use) the service. Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Disclaimer

AgentMorning is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free service. We are not responsible for the outcome of any real estate deals, transactions, or business decisions you make while using the service.

Termination

You may stop using AgentMorning and delete your account at any time from Settings. We may suspend or terminate your account if you violate these Terms, with or without notice. Upon termination, your right to use the service ends immediately. We will retain your data for up to 30 days after deletion to allow for recovery, after which it is permanently purged.

Governing law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the service shall be resolved in the courts of competent jurisdiction. You agree to attempt to resolve any dispute informally by contacting us before initiating formal proceedings.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "last updated" date at the top. For material changes we will notify you via email or an in-app notice at least 14 days before the changes take effect. Continued use of AgentMorning after the updated Terms take effect constitutes your acceptance of the changes.
